1. Purpose

Wherely is a mobile app that lets you catalog items by photo, organise them, and lend them between users. These terms govern the use of the service.

2. Access and account

Access requires a compatible iOS device and a connection via Sign in with Apple. You are responsible for the use made from your account. The service is restricted to people aged 17 and over.

3. Acceptable use

You agree not to publish illegal content, to photograph only items whose image capture is lawful, and to respect other users. We may suspend an account in case of abuse.

4. Strictly prohibited content

We apply a zero tolerance policy on the following content. Any violation triggers removal of the content and may lead to suspension or permanent closure of your account, without notice.

• Sexual content or nudity.
• Violent, graphic or disturbing content (injuries, death, animal cruelty).
• Hateful content targeting a person or group based on origin, religion, orientation, gender, disability, age.
• Illegal content: illicit drugs, weapons, counterfeits, stolen goods, child sexual abuse material (we systematically report these to authorities).
• Harassment: threats, intimidation, doxxing, incitement to suicide.
• Spam, scam, phishing, disguised advertising.
• Impersonation: pretending to be another real person or a brand.
• Content that violates the rights of others: trademarks, copyrighted works, trade secrets.

On every item and every profile, a “Report” button lets you alert us and a “Block” button bidirectionally hides a user who bothers you. Our moderation team processes reports within 24 hours maximum.

It is also prohibited to circumvent a block by creating a second account, to automatically harvest other users' data, to technically attack the app or the server, or to use the app for commercial purposes without our written authorization.

5. Peer-to-peer lendings

Wherely facilitates the connection between a lender and a borrower, but is not party to the loan. No payment takes place through the app. Wherely does not guarantee the condition, availability or return of items, and does not intervene in disputes between users: the loan is the sole responsibility of the lender and the borrower, who freely set its terms.

6. Content and ownership

You remain the owner of the photos and content you add. You grant Wherely the right to host and display them to the people you share them with, solely to operate the service. The Wherely brand, name and app remain the property of the publisher.

7. Availability

The service is provided “as is”. We do our best to ensure continuity but do not guarantee uninterrupted availability.

8. Termination

You can delete your account at any time from the app. We may terminate an account in case of breach of these terms.

9. Governing law

These terms are governed by French law. Any dispute will be submitted to the competent courts, after attempting an amicable resolution.
